Stallion Service Contract--Shipped Semen

 
1. Stallion owner reserves the right to refuse any mare.  A complete copy of the mare's registration papers
will be provided to the stallion owner at the time of booking.

2.  Stallion owner guarantees viable semen in each shipment.

3.  Stallion owner agrees to ship semen to a veterinarian of the mare owners choice.  All fees for veterinary treatment and/or insemination are the responsibility of the mare owner.  Mare owner additionally agrees to return the shipping container by overnight mail, at their own cost.

4.  Mare owner agrees to give the stallion owner timely notice (minimum of three postal days) of the expected insemination date.

5.  The stallion owner guarantees a live foal from the above mating.  A live foal is defined as one who lives a minimum of 24 hours after birth.  This guarantee applies only if the stallion owner is notified of the death of the foal within one week, and such notice must be accompanied by a statement from a licensed veterinarian stating the probable cause.  Stallion owner agrees to rebreed the mare the following breeding season.  This rebreeding may be transferred to another mare by mutual agreement of the mare and stallion owners.

6.  This stallion stands with an additional color guarantee when bred to colored (regular registration) APHA mares.  Should a solid foal result from the above mating, mare owner may rebreed the following season at no additional breeding or booking fee.  If the shipped semen option is used, deposits and collection fees will be assessed.

7.  Should the stallion become unable to fulfill the terms of this agreement due to death, illness, injury or sale, this contract is null and void.  Moneys paid for booking or breeding fees will be returned, but board and other expenses will be borne by the mare owner.

8.  Stallion owner will execute all documents necessary for appropriate breed registry.  A breeder's certificate will be issued to the mare owner upon notification to the stallion owner of the foal's birth (provided that all moneys owed are paid.)

9.  Container deposit must be paid in full before any semen is shipped, with subsequent shipments charged at an additional $150 each.  The service fee is due and payable upon verifaction of the mare's pregnancy.
FEES for such service shall be $600.

ADDITIONAL CHARGES: 
$250 refundable deposit for AI container (returned after breeding is completed) 
$150 handling fee per collection for shipment.
Should the mare owner breach this agreement, payment of reasonable attorney's fees, court cost and/or other collection expenses shall be the responsibility of the mare owner.
